A Study Of The Path Of Chinese Government Under The Rule Of Law

Constructing a government under the rule of law is an important part of implementing the strategy of governing the country according to law.In September 1997,the 15 th National Congress of the Communist Party of China put forward clearly the strategy of "ruling the country by law and building a socialist country ruled by law".In March 1999,this strategy was formally incorporated into the Constitution.In March 2004,Premier Wen Jiabao made clear for the first time in the government work report on the goal of building a government under the rule of law.In October 2014,4th plenary session of 18 th CPC Central Committee passed the Communiqué of CPC Central Committee on Promoting the rule of law a number of important issues.Third point of the Communiqué called “to promote administration by law,to speed up building a law-abiding government.” We can see that our country for the establishment the government under the rule of law has never stopped.However,there are still some problems to be solved in the government promotion model under the guidance of construction of rationalism.This paper hopes to find out and solve the problems and risks from the history of Western and Chinese Government under the Rule of Law and the Path Logic of Contemporary Chinese Government Construction.The first chapter of this paper points out the background of the construction of the government under the rule of law in China,expounds the relentless pursuit of the rule of law in China and the related academic research since the founding of the People 's Republic of China,and finally explains the research ideas and methods of government-led government construction.The second chapter and the third chapter respectively study the evolution of the rule of law in the West and China.The second chapter is mainly about the evolution of the natural law in the West and the practice of the civil law countries and common law countries.The third chapter analyzes the three aspects of the rule of law in ancient China,the change of rule of law in modern China and the rule of law in contemporary China.The fourth chapter focuses on combing the logic of the theoretical path of constructing the government under the rule of law in contemporary China.First of all,the author puts forward the motive force of national promotion and endogenous motivation of society.Then,the author points out that the dual path of government-led and natural evolution is the dual path of China's development.Finally,the specific path of the difference between the central government and the local government in the political practice under the guidance of the government is expounded.Based on the theory of path logic,the fifth chapter puts forward the problems and risks in the path of the construction of government-promoted rule of law from the theoretical predicament,potential contradictions and practical problems in three aspects.In the sixth chapter,based on the critique of Hayek's constructivist rationalism and the problems of the mature leadership system and the existing power control system,this paper puts forward the reform strategy from three aspects: the path idea,the path practice and the current power control system.
