China's land reserve system basis on the state-owned property of urban land, it ensure that the land Supply meets the needs of urban construction, and promote the value of land assets manifest at the same time. Our current Land Reserve System is a product of the traditional urbanization, but also one of the institutional factors that create the abuses of traditional urbanization. During the operation of China's land reserve system, due to the lack of maturity of legal regulation, the land reserve behavior deviate from it's aims originally designed. The legal status of the land reserve agency is not clear, the scope of land expropriation is too wide,and sources of funds in land reserve facing lots of difficulties. More importantly, land bank lack of planning constraints and supervision and other issues hindered the play land reserve system functions.At present, the urbanization of China is in the period of transition, we pay more attention on the urbanization of "people" than on the urbanization of "ground". At the same time, we emphasize more attention to increase land use efficiency, and to improve the living environment and ecological protection furtherly. With the market trading pattern of collective management of construction land, the government's monopoly of the land market through the land reserve system has been broken, land supply will show a dual pattern structure. Meanwhile, with the urban development boundary delimitation, the expansion of suitable reserve land has been limited, the scope of land reserve will be mainly limited in stock of land, and the way of land reserve will rely mainly on the acquisition of land rather than land acquisition. The process of urbanization in the transformation of government functions, logically requires local governments to adjust roles, norms and constraints of their land assets management behavior.In the transition of urbanization, the key to improve the land reserve system is to ensure that it fits the public welfare. We need to define the legislative principle of land reserve system, in order to correct the deviation of the role of local government. We should raising the level of reserve land legislation with a clear legislative purpose to constrain the behavior of the local government land reserve. Also we recommend that the functions and responsibilities of land reserve institutions should be clearly specified, divesting its land development and management functions. In addition, it is necessary to improve the land acquisition legal system with a pre-emptive rights for the government. Establish a diversified financing channels is really crucial to achieving the goal of reserve land. At the same time, it is essential to strengthen the urban planning of land reserve constraint mechanism on the basis of recommendations, and to improve the land reserve plan management system through information disclosure, enhance public participation and legal supervision.
