Research On The Professionalism Of The Chinese Representative Of People’s Congress

The Party’s eighteenth Fourth Plenary Session proposed the construction of the socialist legal system with Chinese characteristics, stressed the need to adhere to the legislation first, and play a leading role in promoting legislation to seize the key to improve the quality of legislation. In China, the legislative power belongs to the National People’s Congress and its Standing Committee. The capability and performance ability of deputies determine the level of the quality of legislation. Therefore, the key to the construction of China’s socialist legal system is to further improve the National People’s Congress system.The members of the current People’s Congress system, in addition to the members of the Standing Committee are full-time, the rest are part-time. In practice, because of the limit of their own job, part-time deputies are often incompetent in their representative work, so as to the appearance of deviations to the designed system. Refinement of social division of labor are increasingly demanding professional people to do professional things. A major work of the deputies is to draw up and amend laws, however, formulation and revision of the law is a highly specialized and time-consuming work. So the current part-time deputies will not be able to meet the needs.As we all know, in the parliamentary system of western countries, its part-time Members of Parliament have been strictly limited, and most of which the part-time Members are prohibited, in another word, they are totally full-time. The full-time working system of Members of the West is the product of specific historical background, to a certain extent, it promoted the development of Western capitalism. The development path of Western parliamentary system can provide some experience for reference to improve our People’s Congress system.China is not only a regional power, but also the most populous country. The reforming of part-time deputies can’t be achieved in one day in china. In studies of people’s congress, there are many scholars putting forward rational and gradual suggestions of building full-time deputies system. On this basis, through the study of Western parliamentary system, and combined the current electoral system, I put forward the proposal of professional building our county’s Congress deputies, and analyze the safeguard system of the full-time deputies.
