Legal Research On Policy Environmental Impact Assessment

With the increase of social risk,environment risk is increasing either,project environmental impact assessment which is at the bottom of the decision making has been insufficient to resist the harm of environmental risk in modern society,from the top of the decision-making policy of environmental impact assessment has been practiced in more and more countries and regions.As a country focus much on the policy,the importance of macro policy on environmental assessment is out of voice.The environmental impact assessment of the policy level will become the trend and focus of the environmental impact assessment in China.In addition to the preface and the conclusion,This article consists of four chapters.Chapter one is an overview of policy environmental impact assessment.Policy environmental impact assessment is the application of strategic environmental impact assessment at the policy level,systematically evaluate the environmental impact that existing or planned policies and their alternatives may have,and the planning environmental impact assessment belongs to the same level.The main content of the policy environmental impact assessment is to assess the environmental impact of the policy,in order to achieve sustainable development.Chapter two explains the current situation and practice of the policy impact assessment of our country policy.Article 14 of the newly revised Environmental Protection Law paves the way for the implementation of the policy environmental impact assessment,and stipulates that the relevant subject should take full account of the environmental impact in the formulation of economic and technological policies and make reference to the opinions of the relevant experts and the public.In practice,there are three modes of international environmental impact assessment.China's policy environmental impact assessment model is "early warning + protection".Chapter three chooses the American,British and Taiwan regions of China,and elaborates the institutional framework of the policy environmental impact assessment of these countries and regions.It mainly introduces the subject,the object and the content,and provides the experience of the construction of our policy environment impact evaluation system Learn from.Chapter four puts forward the idea of the policy environment impact evaluation system framework from the subject,object and content.The main body,the evaluation unit,the approval department,the review team and the public together with the policy environment impact assessment system of the main body.In addition to economic policy and technical policy,sectoral policies,regional policies and indirect policies are included in the scope of the evaluation.Content,mainly to improve the supervision mechanism and improve the public participation system,while clear the legal responsibility,the establishment of resource sharing mechanism,the protection mechanism of the operation and sound.
