Study On The Causes Of Migrant Children's Crimes And Countermeasures

In recent years,criminal cases of children living with the rural migrant workers in cities have increased year by year,so these migrant children's crimes have become the focus and thorny problems of society,arousing attention of justice departments,educational institutions and social media.In this paper,through an interview survey,a quantitative analysis was conducted on crime problems of migrant children in Yong'an City,Fujian Province by using statistical method,so as to propose constructive opinions on the current juvenile crime prevention and control policies and to extend the functions of prevention and control institutions by innovative ideas.The results showed that there are significant differences in aspects of complicity,education and accusation between non-migrant children and migrant children.On this basis,this paper analyzed the causes of the migrant children's crimes with the relevant theories about migrant children's crimes and explained the root causes of their crimes.The conclusion showed that the causes of their crimes mainly involve several factors: confusion and disorder in personal value judgment and behavior choice caused by premature socialization-induced socialization failure and social anomie,influence of crime subculture,weakening of social control.In current criminal prevention mechanism,the existing policies had shortcomings for deviant behaviors of migrant children,such as early intervention deficiency and labeling corrective measures,resulting in imperfection of current crime prevention mechanism in prevention of migrant children's crimes.From the perspective of crime chain,various types of factors that cause crime can not be effectively controlled;from the perspective of prevention mechanism,there are contradictions that can not be effectively reconciled,resulting in a high incidence of migrant children's crimes.This paper positively puts forward some suggestions on how to solve the problem of current criminal policies for migrant children's crimes,and on this basis,this paper also proposes solutions for difficulty in responsibility stratification and contradictions within the system against this issue.From three aspects,i.e.crime prevention and penalty,following up and settlement after treatment,effective measures are proposed,so as to establish a new prevention and control system for migrant children's crimes.This new system should be a trinity system with the involvement of family,school and society.In addition,for the penalty of migrant children committing crimes,standardized legal norms shall be established,so as to extend the judicial functions and to protect and save these children.And after treatment,from the perspectives of following up and settlement,a protection and rescue system for migrant children committing crimes should be established for the sake of effective prevention and control of crimes.
