The Study On The Effective Cohesion Between The Inner-party Regulations And State Laws Based On The Institutional Anti-corruption

In the 4th Plenary Session of the 18 th CPC Central Committee,It has mentioned that integrating inner-party legal system into the socialist legal system with Chinese characteristics can facilitate the integration of party discipline and national laws,which affirmed the necessity of the research on the theory of the cohesion between the inner-party regulations and state laws.That “the party must manage and administer himself with greater efforts” put forward in the 6th Plenary Session of the 18 th CPC Central Committee,once again raised our Party's attention to strengthen Party discipline.The Seventh Plenary Session of the Central Commission for Discipline Inspection summarized the work experience since the 18 th National Congress of the CPC,advocating that “to comprehensively strengthen Party discipline,it is urgent to seize the fundamental of serious inner-party political life,truss the ‘system cage' tightly,and strengthen the inner-party.” This shows that institutional anti-corruption plays an important role in promoting the construction of clean government and combating corruption.The inner-party regulations are the institutionalized ideology of the requirements of party discipline,as well as national laws are the basis of ruling the country by law,but also the two indispensable prerequisites of the institutional anti-corruption.Based on the institutional anti-corruption,to realize the organic unity of ruling the country by law and administering the party by regulations with the aim of punishing the crime of corruption more efficiently,there is a need to clear the different functions of inner-party regulations and national laws under the institutional anti-corruption meanwhile to realize the reasonable distinction and the effective cohesion of inner-party regulations and national laws: the reasonable distinction mainly refers to the distinction of different boundaries,different areas and different criteria between inner-party regulations and national laws;the effective cohesion is to realize the cohesion of target orientations,accepted objects and programs of inner-party regulations and national laws.In the real practice of anti-corruption,there will be some obstacles in the cohesion of inner-party and national laws,therefore,we need to establish the basic principles for their effective cohesion to strengthen the communication and coordination of inner-party and national laws.In addition,in order to deal with the obstacles of their cohesion,that is,to jointly build the ‘system cage' and strengthen the supervision of the power,we should strive to build the long-term mechanism that the leading cadres dare not rot,are not able to rot,and do not want to rot.
