Research On Legal Regulation Of Network Shopping Price Fraud

With the development of Internet technology and the increasing popularity of the Internet,online shopping because of its relatively low price,and the kinds of comprehensive and the convenient way to buy to become more and more consumers' choice.In addition to bring a huge impact to the traditional line shopping,the breeding problems along with the network shopping is endless.In 2016,the total turnover of Tmall's "double 11" is 120.7 billion yuan,and the stragglering number behind many problems worth exploring.Among them,electric business price fraud is one of the important problems which is actually a commonplace problem.As early as 2015,the price supervision bureau of the national development and reform commission made clear in "To standardize the behavior of online retail prices on the reminder book" to clear in the "double 11" period will be thorough investigation of price fraud,and regulate the price behavior of goods,but network shopping price fraud is still difficult to eliminate.The scandal of e-commerce price was revealed,but the merchants are incorrigible.Investigate its reason,in addition to the lack of regulation and supervision of the network shopping price fraud,the relevant department give light punishment for electricity price fraud is also important reason.For the illegal bussiness compared with the benefits of illegal,the penalty is basically just a drop in the bucket,lacking of deterrence for them.With the development of electricity industry,network shopping price fraud is also increasingly complex.In the case of imperfect legal regulation,it is more difficult to safeguard the interests of consumers,legitimate competitions and other entities.This paper starts with two classic cases of network shopping price fraud,leads the topic.Then it analyzes the concept,connotation and extension of network shopping price fraud from the oretical,distinguish it from traditional price fraud.And continue to analysis network shopping price forms of fraud conducted analyses,and introduced its origin which is the theoretical starting point of this paper.Then,contact the status quo of China's legal regulation,including regulation of Consumer Protection Law,E-commerce Law,Price Law,Law of Against Unfair Competition,combined with foreign network shopping price fraud regulation and supervision advanced experience,and then summarizes proposes reference for us.Finally,this paper discusses some reflections of the legal regulation of network shopping price fraud.Based on the theoretical basis of economic law,this paper analyzes and defines the network shopping price fraud itself and its related legal regulation,starting from the social reality,taking the real cases as the entry point and combining with the domestic reality.This paper takes the case analysis method,the comparative analysis method,the legal norm research method and examples of analysis method to analyze the problem.The key point is to solve the related problems of the regulation of network shopping price fraud,and finally get relevant suggestions for the problem.
