Global child welfare keeps a great pace to close to Pratt & Whitney type,the direction of development,the protection of child rights become an unavoidable task of a modern civilized country,how to ensure that child welfare policy and law can maximize attention to child welfare issues,respond to child social problems and meet child welfare needs,become a service-oriented government's most concerned welfare issues.As a normative text of child welfare,it's child welfare policy and law that the most efficient implementation and coercive means of child welfare system design,it's a powerful weapon that restrains the implementation of the government's child welfare administration and a strong fortress to protect the welfare of child.The theory and practice of child welfare shows that the design of child welfare system is an inevitable standard of child welfare maturity.However,by the political,economic development level,social environment and public awareness and other factors,China's child welfare system is still relatively backward,that is far from developed countries.Specifically in:from the child welfare policy level,although China has formed a more complete child welfare policy system,but there are still many problems.For example,the child welfare-related policy are relatively scattered and fail to form a unified national child welfare system;The legitimacy and feasibility of child welfare policy are flawed,and the operability and effectiveness are insufficient.From the child welfare legal point of view,although there are introduction of child education,health care,justice,basic survival and other aspects of the relevant laws and regulations,but the protection of child welfare rights still exist in the larger loopholes,the situation is worrying.For example,our country has not yet enacted a child welfare code,and the law related to child welfare crosses chaos and fails to form a unified child welfare legal system;Child welfare law development subject,content,development procedures,etc.have yet to be improved,there is room for greater improvement to child welfare legislation research,legal cost and benefit analysis,the legal effect of the implementation of the law based on the empirical analysis;There are still long management and lack of coordination and accountability mechanisms in the administrative system that is compatible with the child welfare law.In response to the above questions,in terms of our country,we need reexamine the problem of child welfare system design from the two aspects of child welfare policy and child welfare law.First of all,we need to use the theory of legal policy to understand child welfare and think about the way of child welfare system design;Secondly,we need to actively explore the child welfare system in developed countries,inspired by its essence,and used by me;Again,from the child welfare policy level,the concept of child welfare policy to be carefully read,pondering,extraction for China's national conditions of the Pratt & Whitney type development concept,to realize the three-dimensional development of our children,we need to improve the legitimacy and feasibility of our child welfare policy itself,and ensure that policy plays a role of guidance to legislation;Finally,from the child welfare legal point of view,we need as soon as possible to develop an effective child welfare management system,the introduction of a unified child welfare laws,to be lawful,set up a sound child welfare administration system to ensure that law enforcement must be strict,the establishment of a special child welfare fund management system,which is the basis for child welfare to carry out the material and funding.It should be said that from the perspective of legal policy analysis of child welfare can find new problems,access to new inspiration,and ultimately get the best answer to the child welfare system design.
