Research On The Problems And Proposals For The Supervision Of Country Level People’s Congress To The Government

According to the constitution and the laws,the system of People’s Congress is the fundamental political system of China.It has played an important role as the basic organizational form of power in our country in ensuring that people can exercise the state power fully.Four basic powers of the People’s Congress are given by the constitution and the laws,which are:the right to decide on major matters,the legislative power,the right of appointing or deposing officials and the right of supervision.There is no legislative power for the grassroots People’s Congress especially the county level People’s Congress,whose main responsibility is the supervision.The purpose of the supervision is to certify proper implementation of the constitution and the laws and regulations in this area,also to ensure that the people’s government and the people’s court and the people’s procuratorate execute administrative power,judicial power and procuratorial power by law.In recent years,the People’s Congress at the county level has been constantly innovating and exploring actively,and has accumulated a lot of valuable experience in supervising the work of the govemrnment.It has fulfilled the supervision right with the times and created a new situation to supervise the work of the government.However,due to various reasons,there is still a certain gap between the effectiveness of the supervision of the People’s Congress and the expectations of people.The supervision of the county level People’s Congress does not play its due role,especially in the supervision to the government.It has many problems,mainly in the inadequate supervision,not-standardized procedures,limited professional knowledge,the lack of rigid supervision and so on.Therefore,researching on the supervision of the county level People’s Congress to the government can help us to find out the problems existing in the practice and the deficiencies of the supervision system,and also help us to provide an important reference for the improvement of the supervision system.It is of great practical significance to explore some operable countermeasures to enhance the effectiveness of the supervision of the county level People’s Congress to the government and promote the government to execute administrative power by law.This paper consists of five parts.The first part mainly expounds the significance of the topic,the related research literature,the research ideas and methods and innovations.The second part interprets the related theories about the supervision of the county level People’s Congress to the government,including the concepts,the contents,the characteristics and theoretical basis of the supervision.The third part focuses on the current situation and the problems of the supervision of the county level People’s Congress,with Yuancheng District as an example.It introduces the basic measures of supervision and the achievements in Yuancheng District for the last five years,and analyzes the main problems existing in the supervision work of the People’s Congress according to some statistical data,such as inadequate supervision,low quality of consideration,less feedback,low professional level,less rigid supervision and so on.The causes of the problems are analyzed.The fourth part focuses on the countermeasures to improve and strengthen the supervision to the government by the People’s Congress at the county level.The fifth part is the summary of this research.The problems enumerated is local in this paper which takes Yuancheng District as the example,but also has a certain universality.The countermeasures proposed have some universal value.The possible innovation of this paper is to combine the actual work,and to find out the problems from the practice and analyze them.The survey of the status is realistic,and the analysis of the data is more scientific and accurate.Firstly,the countermeasures proposed in this paper are feasible,such as applying the special inquiry and improving the research methods.Secondly,they are forward-looking,such as the innovation of budget supervision,exploring the citizen participation in supervision.Thirdly,they are applicable to enhance the effectiveness of the supervision of the county level People’s Congress,and to improve the supervision power endowed by the constitution and the laws.
