Study On The Joint Legislation Of Coastal Ecological Zone

Though the coastal development strategies are promoting the rapid development of coastal cities by favorable policies,large-scale development activities led to a sharp deterioration in environmental conditions of coastal ecological zones,the stability of ecosystems threatened.From the perspective of environmental legislation,the coastal cities,having obtained local legislative power,should break the administrative barriers,share the legislative resources,and implement the joint legislation system of the coastal ecological zones to realize the standardization and legality of the development and utilization of resources in the coastal ecological zone as soon as possible.The introduction part introduces the research background,the research significance and the domestic and foreign correlations research,and explains the theoretical basis of joint legislation of the ecological zone.In this part,the author analyzes the concepts of "ecological zone","coastal ecological zone" and "joint legislation",providing a theoretical basis for the following discussion.The first chapter is the necessity and feasibility of the joint legislation in coastal ecological zone.The author holds that on the one hand it is necessary to carry out the joint legislation,because it is an important guarantee to promote the protection of coastal ecology and to realize the uniformity of the legal system of the coastal ecological zone,on the other hand,it is feasible to carry out the joint legislation in coastal ecological zone,because there are relevant provisions on local legislative power in "The Legislation Law of the PRC" and "Organic Law of the Local People's Congress and Local People's Governments of the PRC",and some regions have rich experience in collaborative legislation which can be used as a reference for the joint legislation of coastal ecological zone.The second chapter is the model of the joint legislation of coastal ecological zone.The author considers the complex characteristics of the ecological elements of the coastal ecological zone of Jiangsu Province and then discusses the model of the joint legislation of coastal ecological zone,including the legislative bodies,the detailed content and the main programs.The people's congresses of the coastal ecological zone and their standing committee act as the legislative bodies of the joint legislation.A special coordinating agency should be set up to facilitate information and opinions exchange among the legislative bodies.The contentsof the joint legislation of the coastal ecological zone should include clarifying the legislative duties of the legislative bodies,standardizing the responsibility of the government,strengthening the environmental responsibility of the enterprise and improving the relief system of environmental tort damage.The main procedure of the joint legislation consists of the overall Planning,drafting,deliberation and effect assessment.The third chapter is the guarantee mechanisms of the joint legislation of coastal ecological zone.The author explains the guarantee mechanisms throughout whole legislative process.Before the drafting of the legal case,legislative authority allocation and legislation reasoning should be used to ensure the smooth operation of the joint legislative preparation activities.During the core process of joint legislation,communicating and consulting mechanisms and public participation mechanisms should be used to improve the effectiveness of legislation and the quality of draft.After the adoption of the draft law,both the establishment of the mechanism of signing the contract and the improvement of the conflict resolution mechanism are the important measures to guarantee the stability of the joint legislation achievements.
