A Research On Problems And Countermeasures Of Administrative Law Enforcement Of Lake Management In Wuhan

As the provincial capital of Hubei province,Wuhan has historically been crowned as"the city of a hundred lakes".The lakes in Wuhan have long played an important role in its economic development.But with the growth of economy and society,these lakes also face major problems and challenges,including illegal filling and appropriation,aquatic-breeding and worsening pollution,which greatly undermines the lake resources and the lake ecological environment and hinders the development.It's imperative to further enhance the lake management of Wuhan.The lake management has involved quite a few means,such as economy,politics and rule of law while the administrative law enforcement acts as the important content of these.Therefore,in terms of the administrative law enforcement of the lake,the paper aims to help Wuhan to further strengthen and improve the administrative law enforcement of lake management by means of such research,so as to provide experiences and valuable reference for advancing the management and protection of China's urban lakes and water resources.The paper consists of four parts.The first part is the introduction to summarize the international and domestic recognition,experience and overview of the law enforcement of the lake management.Besides,the research background and meaning are presented and the research methods and ideas of the paper are briefly discussed in the first part.The second part has outlined the administrative law enforcement of the lake management,including the concept of the lake management and the administrative law enforcement,as well as the four methods and meaning of the administrative law enforcement of the lake management,including the principal part,duty,administrative licensing,administrative penalty,administrative compulsory enforcement and administrative inspection about the administrative law enforcement of the lake management.The third part has discussed the present situation and the existing problems about the administrative law enforcement of the lake management in Wuhan.In this part,the developing history and situation of the administrative law enforcement of the lake management in Wuhan are introduced,and five problems are highlighted,such as the integrated law enforcement system that is not effectively straightened out,the irrational administration licence supervision system,insufficient law enforcement,weak law enforcement and surveillance,incomplete legal basis of the law enforcement of the lake management and unsound law enforcement accountability system.The fourth part is to propose the legal basis of improving the administrative law enforcement of the lake management for the existing problems of the administrative law enforcement of the lake management in Wuhan,so as to give the corresponding research solutions,including rationalizing the lake integrated law enforcement system,enhancing the administrative law enforcement of the lake management,standardizing the lake administrative licensing procedure and strict accountability of ineffective enforcement.The difference of the paper lies in its new proposed concept,that is the concept of "the administrative law enforcement of the lake management".It separates the administrative law enforcement of the lake management from the law enforcement of water resources to better shed light on the aspects that need to be improved and enhanced.The two systems are exploring,one is the mode of the integrated law enforcement system reform to put forward the three reform modes,namely,the large,middle and small scale.The other is to explore the application system of administrative enforcement law and law enforcement practice.There are three focuses on the administrative law enforcement of the lake management for the targeted problems,namely,the focus on the improvement for the legal basis of the administrative law enforcement of the lake management,the focus on the system construction of the the administrative law enforcement of the lake management and the focus on the team building of the administrative law enforcement of the lake management.
