Both in traditional Chinese society and in the ancient west,the police have a long history.The presence of the police has inseparable relationship with the emergence of nation.Since the advent of the police,they take on the responsibilities of maintaining social order.Because the police and the state,the police power and public power are closely related,the study on the police and police power must be combined with background of times and the political.In the autocratic society,the police power is the embodiment of the autocratic monarchy authority on the social management,which fights against people's rights.After entering the society under the rule of law,the police power was greatly limited.Like other executive power,it must have legal authorization.The exercise of the police power must be conducted in accordance with statutory procedures and ways.Our constitution and law do not directly define the police power,but the People's Police Law provides for 14 police authorities.Police authority is the concrete expression of the police power and the police power is the abstract police authority.Diversified law enforcement is the essence of the police power in our country.It not only has the power of management and law enforcement,also unceasingly shifts to the service-type power.And the contents of the police authorities in China are constantly enrich and perfect.However,the police power is public power,which has the extinct character of expansion,so the excessive expansion of police authorities must be reconfigured by law to achieve check and balance.Auxiliary police is the inevitable outcome of the insufficient police strength,and it is one of the products of the reconfigured police authorities.The presence of auxiliary police is beneficial to ease tensions on the police force,improve administrative efficiency,reduce administrative pressure,and ease the employment pressure and so on.Foreign auxiliary police system is comparatively perfect and achieves high degree of legalization.Although our low starting point,after years of efforts,the good situation that the central and regional legislation go forward hand in hand has already emerged.However,there are a number of problems in our country's auxiliary police management,such as insufficient welfare,nonstandard labor recruitment,unclear boundaries of responsibilities,relatively low overall quality and imperfect discipline.These problems are largely due to the insufficient knowledge on the nature of the auxiliary police.At present,many domestic scholars believe that auxiliary police are just the extended hand of police,without any subjective consciousness.This view leads to the auxiliary police's occupational identity is not strong,the cooperation of police and the auxiliary police is insufficient and the lack of funds.Therefore,it is necessary to give the subject status to the auxiliary police.Except for high police authority,they should conditionally participate in lower police authority,and can take part in part of the law enforcement activities independently.In addition,external management and internal incentive should be adopted to straighten out powers and responsibilities of the auxiliary police and the police and the management modes to improve fighting strength and achieve the value of the system of the auxiliary police.
