With the development of economic globalization and Internet,cross-border e-commerce became the trend of the new era.Due to the differences existing in domestic products and foreign products and foreign products for convenience,consumers is keener on cross-border consumption.What is undeniable is that cross-border e-commerce brings great convenience to people's life and improve the quality of life.On top of this,because of the characteristic of the cross-border e-commerce,the protection of the rights and interests of consumers in the cross-border electricity is a big hidden trouble.In this paper,cross-border e-commerce is defined and the legal relationship of cross-border e-commerce is easy combed in the first part of the concept,for subsequent analysis of the problems and countermeasures of protection of the rights and interests of consumers.And then e-commerce consumer rights protection legal system the EU and OECD is introduced.The second part analyzes the present situation of the protection of consumer rights and interests of cross border e-commerce in China.The third part analyzes the main legal problems faced by the protection of consumer rights and interests in China's cross-border e-commerce.The first is the basic rights of consumers in cross-border e-commerce,such as right to know,privacy,The second is the cross-border electronic payment problem,this paper mainly selected the unauthorized allocation of funds and the management of consumer reserves,the third is the dispute settlement mechanism in the protection of consumer rights issues,mainly from the traditional dispute resolution mechanism and the current dispute settlement mechanism.In view of the above problems,this paper puts forward the corresponding countermeasures in the fourth part from the aspects of establishing the certification and approval system,strictly disclosing the obligation of information disclosure and strengthening the problems faced by the protection of the basic rights of consumers.It is suggested that,in view of the problem of the protection of consumers' rights in cross-border payment,this paper puts forward some suggestions on how to establish the mechanism of handling the liability of the unauthorized payment transaction and the improvement of the reserve fund management mechanism.In view of the main aspects of the protection of consumer rights in the dispute settlement mechanism Problem,this paper makes suggestions from the establishment of third-party platform complaint mechanism,the establishment of a sound new online dispute resolution mechanism and international cooperation.
