Study On Cropland Protection Policy In China From The Sight Of Administrative Law

Cropland is base of agriculture and grain production,and is dispensable means of production for farmers.Whether cropland can be protected properly is directly related to the long-term livelihood of millions of farmers and development of socio-economy in China.According to the Second National Land Survey Bulletin,China has 135.3 million hectare cropland,which is slightly more than the Deadline of Cropland in order.However,since Reform and Open,a great quantity of cropland has been exploited,which led to a continuous decrease of cropland gross.Cropland protection has entered the superheating stage due to its crucial importance for implementation of Scientific Outlook on Development and construction of a harmonious society.Reasonable use and management of cropland plays an important role in stabilizing development of society and economy.However,use and management of cropland in certain region is achieved by each power subject.Meanwhile,administrative law is a public law which is based on public advantages.Therefore,using administrative law to relieve the conflict between personal advantage and public advantage is a key point.Administrative methods are authoritative and compulsive.Administrative law gives administrative subjects management methods,such as administrative order,administrative guidance,administrative punishment,to regulate and manage socio-economy.Administrative methods can maintain centralization and unification of administrative management system,which is beneficial to function of administrative organization.At the same time,administrative methods are elastic to measure various socio-economic issues.However,in the processing of cropland protection,administrative methods also have some limits.For example,it will be difficult to exert administrative subjects' activity,initiative and creativity,which impact the development of cropland protection in China.This research firstly analyzed current cropland protection policy in China by recognizing the conceptual framework and fundamental theories;secondly,chose three typical cropland protection policies of China,which are Land Use Control Policy,Cropland Dynamic Balance Policy,and Basic Cropland Protection Policy,to clarify the presentsituations of each policy;thirdly,summed up the problems of each policy by analyzing the current situations;finally,proposed better arrangement accordingly,and advices for administrative subjects and decision-makers of Chinese cropland protection.
