| The popularity and development of the Internet,gave birth to a new way of trading--e-commerce which now has been gradually accepted and praised highly.E-commerce was known as the revolution of the new century business model with its convenient,fast,efficient and other advantages.Compared with the traditional transaction mode,the e-commerce will bring greater challenges for the consumer's online rights and interests because of its own particularity and the risk of the transaction.Based on the analysis of the difference of e-commerce and traditional transactions in terms of technology and business models,different types of consumer online equity types,the main analysis and traditional transactions will not reflect and put forward new challenges of the rights and interests.In addition,due to the lag of laws and regulations,the protection of consumer rights in e-commerce faced with many problems,such as consumer awareness could not guaranteed;consumer privacy was abused;network fraud and false advertising everywhere;electronic payment security had loopholes;after infringed,the consumers' rights and interests could not be relied.Based on the reality of China's e-commerce practice and the existing legal norms,the government will learn from the advanced experience of foreign consumer protection to build China's private law as the core protection system of the consumers' online rights with the public law mechanism and soft law mechanism as the supplement.The consumers' online rights and interests of consumers are related to many legal systems and legal departments,therefore,I will include the contract law and other laws of the problem into these three stages and solve the problem of consumers' online rights protection according to the three stages of the contract,to make the article more structured and well-bedded.So as to systematically sort out the private law mechanism of the whole consumers' online rights and interests and propose the solution to the problem. |
