The Study For Administrative Protection Of Consumer Online Rights And Interests

With the improvement of technology and concept, electronic commerce is more and more important in the common people life, online shopping has gradually become important consumption way. In our country, development of electronic commerce and the level of consumer protection contrast strongly. Protection of consumers online rights and interests has drawn greater attention. Disputes of online shopping occur repeatedly, but the law is hardly adapted to it.In the field of electronic commerce, due to the unequal status between online consumers and business operators, information asymmetry, improper competition and monopoly industry, leading to market failure. Accordingly, consumer rights and interests can not just rely on market, country also undertake important responsibility for protection of consumers online rights and interests. Administrative protection is a national civil relationship to intervene in private law. For study of administrative protection, we will discuss in the field who or what organization based on which specification ways to achieve the goal of consumer rights and interests of administrative protection online. Thus it can be seen, administrative protection contains four elements,for example:subject(the administrative subject),object(the consumer online rights and interests),norm(the legal Norms), the protection measures. At present,administrative protection system of consumer online rights and interests have already produced a prototype, but there are still some shortcomings,for example: subject right configuration is not reasonable, legal norms is imperfect, the protection measures is not sound, then leading to rights and interests can not get effective protection. Therefore, for study it,we should be defined by the system for forming, standardize subject, perfect legal norms, improve the protection measures, so as to build the perfect administrative protection mechanism of consumer online rights and interests.
