On The Control Of Illegal Immigration By Law In China

In the era of globalization,as an irregular way of international population migration,illegal immigrant issue has become a world-wide problem.China is not traditionally an immigrant country,though,as a member of the international world,it's facing an inevitable trend of transnational migration as it's deepening its opening-up and development,along with the illegal immigration problem that will bring China unprecedented challenges to national security,economic order as well as to social management.China's government is always holding a negative attitude and taking tough measures against the issue,including a ‘campaign-style'crack-down and repatriation of illegal immigrants.Meanwhile,the domestic legislation yet is not compatible with China's current situation,with backward law enforcement and less advanced management methods.Only by the mere ‘campaign-style' crack-down of illegal immigrants,the government is not getting a desirable result,while causing a huge waste of social resources.So far,almost all the domestic researchers and administrators are holding the same negative attitude and a concept of firmly fighting with illegal immigrants.To my own understanding,illegal immigrant issue is an inevitable and long-lasting phenomenon of globalization.It's also undeniable that illegal immigrants are not only bringing China negative impacts but also positive effects such as filling the gap in the low-end labor force in some labor intensive industry in China,meeting the seasonal demand of labor force border area,etc.Therefore,the government should hold a renewed and wider perspective to this problem and take comprehensive and appropriate measures to solve it,including fighting with smuggling and illegal migration on one hand,and widening the legal ways of migration on the other hand.This paper focuses on the domestic and international legal control of illegal immigrants from a brand-new perspective.
