Research On Criminal Interrogation From The Perspective Of Game Theory

Criminal Interrogation is a kind of investigative behaviors issued by investigators in accordance with legally prescribed process,which aims to obtain the statements and exculpations of the criminal suspects through the mean of questioning and others.It is also a kind of face-to-face interaction that meets the characteristics of Game Theory,focusing on the exposure and concealment of criminal facts between investigators and criminal suspects.Therefore,Game Theory analysis tool could be applied to interrogation from theperspective of systematization and interaction.This paper analyses criminal interrogation game regarding participant's relationship,expected payment,game rule and gamestrategy.It also applies a series of research methods including literature,interdisciplinary,qualitative andmodel analysisresearch.Thepaper is divided into five parts:Firstly,analyzing the research of Game Theory at home and abroad,in order to elaborate its elements and types,combs the blank of Game Theory's research and explicit its meaning in terms of criminal interrogation;Secondly,the result of comparing four features of criminal interrogation and four essential elements of the Game indicates that the criminal interrogation is fully comply with the Game Theory.The four features of interrogation includes the rational participants,the possibility of interaction between participants,the interests of interrogation results,and the knowability of game information;Thirdly,constructing both static and dynamic models applies to relationship among multiple criminal suspects in the joint crime,investigators and the criminal suspects,and investigators with a third person familiar with the situation in the interrogation,and uses the benefit matrix of quantitative expected return and game tree to analyze each participant's strategy choice;Fourthly,it discusses the problems that affect participant's game strategy choice as equal body subjects including limitation of participant's rationality by mandatory interrogation,the performance of the interrogation,the crisis of the interrogation,the agreement crisis that affects participants to reach a cooperation,and the incentive ineffectiveness of lenient policy,so as to restraint the voluntary and true confession of the suspect;Finally,committing to obtain the statement of criminal suspect based on the investigator's perspective.Taking into account the protection of suspects' interests and their equal subjects of the game,the interrogation questions and the game rules should be improved,so as to prompt the benign development of interrogation,increase the confession interests of guide the criminal suspects overcome mental obstacles and voluntarily form statement motivation,ensure the effectiveness of “lenient punishment” agreement after confessed,promote the game participants return to rational state,and put forward the effective strategies of interrogation,according to different stages,conditions and situations of the game to obtain real and stable confession of the criminal suspects.
