| High-speed railways are growing rapidly around the world and are popular for their convenience,efficiency and punctuality.While being able to "race with the wind and fly close to the ground",safety has become a more fundamental pursuit for high-speed rail development.Ensuring the safety of high-speed railway operations is a major challenge for the development of high-speed railways in China.High-speed railway trains run at extremely high speeds,and once there is an abnormal situation that affects safety,it will have a serious impact,disrupting the normal order of the operating organisation,or causing damage to equipment,or even leading to safety accidents and casualties in serious cases.For example,the "7.23 Yong-wen Line Special Major Railway Traffic Accident",the Nanjing high-speed railway jam,and so on.These accidents affecting the safety of high-speed railway operations have exposed the problems in the legal system of high-speed railway operations safety in China,which has restricted the rapid development of high-speed railway in China.Therefore,we really need to re-examine and reflect on the construction of China’s high-speed railway operation safety legal system,learn from the valuable experience and lessons from past railway accidents and foreign railway accidents,and use the rule of law thinking and rule of law to find solutions to ensure the safety of high-speed railway operation.The high-speed railway operational safety system is a dynamic control system of equipment,personnel,environment and technology,based on personnel as the core and equipment as the foundation,achieved through information technology systems.In this paper,by studying the elements of high-speed railway operation safety as well as the problems and causes of high-speed railway operation safety,we propose countermeasures to improve the legal system of high-speed railway operation safety in China.The article is divided into six parts:Chapter 1 introduces the background,significance,current situation,research ideas,research methods and innovations of the legal system of high-speed railway operation safety;Chapter 2,entitled "The connotation of the legal system of high-speed railway operation safety",introduces the equipment safety system,personnel safety system,environmental safety system,technical safety system,which affect the safety of high-speed railway operation.The second chapter is entitled "The connotation of the legal system of high-speed railway operation safety",which analyzes the elements of equipment safety system,personnel safety system,environmental safety system and technical safety system affecting the safety of high-speed railway operation,and explains the importance of each aspect of safety;the third chapter examines the problems of the legal system of high-speed railway operation safety,and selects typical cases such as the high-speed railway "bullying" incident,Nanjing high-speed railway jamming incident.Chapter 4 analyses the causes of the problems,including the inadequacy of high-speed railway operation safety laws and regulations,the imperfection of the regulatory mechanism and standard system,the inadequacy of the mechanism for continuous improvement of safety capability,and the lack of popularisation of high-speed railway safety laws and regulations.Chapter 5 proposes countermeasures in four areas,namely equipment safety,ersonnel safety,environmental safety and technical safety legal protection system,and concludes with a summary of the whole paper and an outlook for the future.The purpose of this paper is to summarise the research results on the legal system of high-speed railway operation safety,analyse the problems in the existing legal mechanism of high-speed railway operation safety and draw on the experience of foreign legal research on high-speed railway operation safety,summarise the lessons learned and propose countermeasures to improve the legal system of high-speed railway operation safety in China,so as to accelerate the sustainable operation safety of high-speed railway and promote the prosperous development of China’s The legal system of high-speed railway operation safety in China will be improved to speed up the continuous operation safety of high-speed railway and promote the prosperous development of high-speed railway in China. |
