The problem of congestion and environmental in our cities is growing,and the effectiveness of existing measures is not significant.Traffic congestion is an effective solution to the above emerging measures,which are seen in many countries.Before we introduce this system,we need to analyse the political legitimacy of congestion charges.This article is based on the three parts of the full political legitimacy of congestion.First,from the concept of the concept,from the concept of the concept,it explains the Intension and Epitaxy of traffic congestion,the study is clearly subject to a narrow study of the subject.To analyze the legal properties of traffic congestion,and think it should belong to administrative charges based on public resources;second,Based on this analysis,further analysis the political legitimacy base of traffic congestion in our country.The charge for congestion is the reality of increasing congestion and pollution.In addition,congestion charges are based directly on the political legitimacy of the administration's special effects on compensation and property rights.Finally,the acceptance of traffic congestion political legitimacy depends on a positive system design.In this article,the last part of this article tries to build a proper traffic congestion system.The first should be explicitly legal.Second,Ratio principle should be introduced in the design of the system.It's the only way to achieve real justice.Finally,the structure of the system should be conducted in public and in a fair way,in which the system is justified during procedures.Therefore,we should establish administrative hearings system,administrative open system and the democratic oversight system during the process of legislative and executive decision-making.
