Study Of Quality Evaluation And Optimization Of The Cases Of The Court System Of Hunan Province

In recent years,The Communist Party of China and People's Republic of China have put forward higher requirements for the quality of court cases,and the judicial demand of the public is also increasing.At the same time,contradictions between more cases and the number of established judges are intensifying.The quality evaluation system of existing is hard to adapt to the current judicial situation.Based on the existing political system framework and the existing judges,this paper carries out the research on the optimization that from the aspects of objectives,evaluation subjects,evaluation contents,evaluation methods and techniques,and the application of evaluation results of the case quality evaluation.And this paper mainly takes the first-hand data that from court system case quality assessment activities of Hunan Province as material,and uses empirical research method and literature research method.Comparison of the two parties that comprehensive evaluation of the judicial performance of the High People's Court of Hunan Province and the evaluation of the case quality of the Supreme People's Court in assessment method and evaluation content system,it shows that the essence of the two are consistent after analysis.In practice operated,the Evaluation Index System of Case Quality issued by the Supreme People's Court that includes judicial justice,judicial efficiency and judicial effect indicators,but the comprehensive evaluation index system of judicial performance made by the Higher People's Court of Hunan Province that additional team construction,internal management and other indicators.The Higher People's Court of Hunan Provincial has achieved good results by carrying out judicial performance evaluation activities.Unexpectedly,it is still not conducive to reversing the decline in the quality assessment of the case,and there are some problems that behave as follows:they have different understanding of case quality evaluation assessment both in evaluation subjects and evaluation objects;it does not lead at the lower court enhance work quality and efficiency,and is difficult to change the plight of more cases with the same people;it is difficult to guarantee that the independence of evaluation subject and the quality of evaluation data,and evaluation methods and techniques need to be improved;the assessment results were not effectively promoted in case quality improvement,improve trial management,and optimize the quality of judges.The reasons for problems above were that:the positioning of the activities of case quality evaluation made by the Supreme People's Court and the Supreme People's Court of Hunan Province was the internal supervision;it lack of self drive mechanism in the subject of evaluation himself;hierarchical evaluation leads to the performance bundling of the upper and lower courts;paying too much attention to the internal ranking;lack of social public participation.The combination of these causes leads to a poor improvement in the quality of the case.On the basis of reviewing the history of the High People's Court of Hunan Province of case quality assessment,aiming at the above problems,based on the theory of public management performance,and drawing on the experience of developed countries in Europe and America and some mature domestic programs,combined with the reality of Hunan,this paper puts forward the optimization idea based on sustainable development and solving problems classified.According to it,put forward the following countermeasures:first,it needs to set up a new location in case quality assessment activities that the evaluated courts carry out self-assessment activities and all sectors of the society participated extensively in these activities;second,the evaluation index system needs based on sustainable development and multidimensional driven;third,it has to solve this problem of data unreal rely on audit of data by third party;fourth,it needs to establish a new method to use the results of case quality assessment based on divided into several items then each item graded.Of course,the activities of the case quality assessment need to be continued.It needs to continue to adopt more optimization measures to improve the satisfaction of the public to judicial justice and to meet the requirements of the People's Congress and party and government organs.
