The Comparative Analysis On Case Quality Evaluation System Between China And The United States

In the context of deepening the reform of judicial system,the report of the 19th National Congress of the Communist Party of China put forward a new goal for judicial reform,namely,deepening the comprehensive reform of the judicial system.Improving the case quality evaluation system is one of the important contents of the comprehensive reform of the judicial system,and it is of great significance for accelerating the advancement of judicial reform.The case quality assessment system in the United States developed earlier,and has formed a relatively mature system so far.There are reasonable factors in the system that can be used for reference.From the perspective of legal sociology,this article compares the case quality evaluation systems of China and the United States from five aspects:the emergence and development of the system,the purpose and object of the evaluation,the evaluation subject,the evaluation method,and the evaluation index.The current implementation of case quality assessment in China proposes the following suggestions for improving the China’s case quality assessment system:Clarify the object and purpose of case quality assessment,clarify the boundaries of the case quality assessment system and trial performance evaluation;Enrich the assessment subject,introduce external evaluation to enhance the diversity of evaluation subjects;Adopt diversified evaluation methods,adhere to the combination of qualitative and quantitative evaluations,and combine internal and external evaluations;Optimize the indicator system and improve the matching of the indicator system mechanism.
