Cycling,as an environmentally friendly trip mode,accords with China’s current strategy of the development of transportation.At present,most cities in China pay more attention to the development of motorization,lacking of infrastructural constructions and legal protections of bicycle riders.The existing researches mainly focus on the distribution of right-of-way from the technical perspective to improve the cycling rate,lacking of researches concerning legal aspects.In this dissertation,the author firstly summarizes the existing scientific as well as sociological researches,and then defines the concept of "the right-of-way of bicycle riders" on the basis of studying the basic concept of the right-of-way,city rights and the features of bicycle riding.Moreover,the author compares domestic situation to the protection of the bicycle riders’ right-of-way overseas.This dissertation elaborates the absence of protection of bicycle riders’ right-of-way in the perspectives of legal protection,planning protection and shared bicycles,coming to the conclusion that the current deficiencies lie in the lack of strategies for the development of transportation and statutory project of cycling plans as well as legislative regulations for shared bicycles,the neglect of environmental protection in distributing the right-of-way,and the disorder of the subject in planning and legal basis.Last but not least,the author discusses the proper solutions to the mentioned problems of the right-of-way of bicycle riders from the interdisciplinary perspective,in order to help build a transportation system ruled by law.Giving rise to the current status of bicycles in the transportation system,the author proposes to establish a mechanism of "fair-priority" allocation concerning the right-of-way,including adding the planning of cycling transportation into the statutory planning,and defining the duty of governments,corporations,and users,so as to solve the problems in using shared bicycles in our country.
