The Research Of Social Security System On Land-lost Farmers In The Urbanization Process Of City

Social security is not only an important content of social fairness,but also an important standard of national civilization progress,and an important weight to measure the party's ruling ability.Improving the legal protection of peasants' social security rights is conducive to the construction of a socialist harmonious society,social justice and polarization prevention.With the acceleration of urbanization in China,the land of peasants has been expropriated,and the number of landless peasants has been increasing.But because our country at the present stage of peasants land expropriation and land compensation legal mechanism is not perfect,and when peasants lost their land in employment,health care,education and other aspects of the lack of security,leading to the present situation of social security of landless peasants.Many peasants lost their jobs after they lost their land.They lost their land,lost their jobs and lacked the necessary social security,which led them to become the "poor" people in the city".Therefore,how to solve the problem of landless peasants' social security in the process of urbanization,and make landless peasants and urban residents have all kinds of social security rights and interests equally,is an important problem to be solved urgently.Taking this as the starting point,explains the city in the process of social security of landless peasants legal status,to find out the social security of landless peasants problems,legal means and to explore the realization of the right to social security of landless peasants.Through the research,this paper thinks that the social security of landless peasants rights still exist in the following related defects in the legal protection level:the enforcement of the right of social security legislation,the lack of peasants of land expropriation and compensation system is not perfect,the lack of social security of landless peasants,landless peasants social security judicial relief system is not perfect.On this basis,this paper thinks that the social security rights of legal realization should be from the following aspects:exploration efforts continue to deepen the reform of the household registration system,improve the peasants land expropriation and compensation mechanism,strengthen the landless peasants social security right enforcement and improve the social security of landless peasants the right of judicial relief mechanism.
