The sharing economy is a new type of economic form after the development of the information revolution.In 2016,‘sharing economy' was written in the government work report which pointed out that sharing economy should be supported in all efforts as well as regulated in an innovative way.In general,there are few regulations of law on all types of sharing economy which demand space and time to grow up.Based on the internet,sharing economy has brought great benefits in production.Accordingly,the government departments have taken regulatory measures in a slack way.The sharing bicycle is no doubt a new form.It is playing a positive role in meeting the needs of the public,alleviating traffic jams and building environmental-friendly travel system.However,we cannot ignore its negative externalities.For example,the sidewalks are crowded with all kinds of sharing bicycles.It is the government's obligation to solve these questions and the emphases should be put on how to solve these problems efficiently and economically instead of quickly.From this point of view,this paper will introduce the theory of third-party liability and attempt to give some advice in the regulation of sharing bicycles.This paper consists of three parts: introduction,main text which has three chapters and conclusion.The first chapter will demonstrate the necessity of regulating the parking problem of sharing bikes.Combined with economic theory and jurisprudence,this chapter generalizes the characteristics of sharing bikes business model,demonstrates the attributes of its public goods and analyzes the negative externalities.The second chapter is the research about the existing regulations on sharing bikes.Through combing all kinds of existing regulation models and management methods,including private law contract,road traffic safety laws and regulations,this chapter analyzes their respective shortcomings and defects.The feasibility and superiority of regulation through the third party obligation theory in administrative law will be put forward in this part.The third chapter is the concrete assumption of the third party regulation mode.Through the detailed introduction of the theory of the third party obligations,this paper tries to construct an operable administrative law regulation model.The conclusion part will reiterate the superiority of the third party obligation theory in the administrative law,assume that it can also play an important legal regulation role in the development process of other new types of business,and protect the healthy and orderly development of the new business modes in the field of sharing economy.
