Research On The Rules Of Goods Trade Of The FTA Among China,Japan And Korea

In 13th April 2017,the 12th chief negotiators’ conference of the FTA of China,Japan and Korea was held in Tokyo,Japan.Rules of goods trading are always the focal spots in the past twelve negotiation meetings.The study of the FTA of China,Japan and Korea normally concentrate on the implement,necessity,significance and barriers according to the analyses of economic and political angles.The thesis is different from the past,the starting point is law especially the internal law and international economic law,which is novel.Also,the thesis will analyze the contents of WTO agreements,GATT 1994 and the FTA of China and Korea.The main methodology will be document analysis method,comparative analysis method and interdisciplinary interaction method.The aim of the thesis is to offer proposals to the contents and text structure of the FTA of China,Japan and Korea.There are four main parts of the thesis.The first part will elaborate the current trade status of China,Japan and Korea as well as the development of the FTA of China,Japan and Korea.It will contain the analysis of the trade value of China,Japan and Korea;the fact that these three countries are significant trade partners for each other;the display of countries that China,Japan and Korea have signed FTAs with;the process of the negotiation among China,Japan and Korea;the obstruction and the meaning of the FTA.The second part and the third part are core parts of the thesis.The second part will illustrate is the crucial part of the thesis which will focus on the construction of trade facilitation items and items of reducing obstacles of goods trade.The second part will include national treatment and market access for goods,rules of origin implementation procedures,customs procedures and trade facilitation.The third part will cover items of SPS,TBT and trade remedies.For each part of the specific rules,the thesis will firstly illustrate the items of WTO agreements,GATT 1994 and the FTA of China and Korea.Then it will provide suggestions to the FTA of China,Japan and Korea on the contents and text structure by comparing the differences in WTO agreements,GATT1994 and the FTA of China and Korea.The third part is conclusion,which based on the analyses of the first,the second and the third parts.
