| Chinese government signed the World Health Organization Framework Convention on Tobacco Control(WHO FCTC),which has been 12 years since then."Banning tobacco advertising,promotion and sponsorship" is an important part of FCTC that reduce tobacco demand.Indirect tobacco advertising is a kind of advertising which is more conceal than the direct way,and its imperceptible harm even exceeds the direct advertising.Due to the problem of indirect tobacco advertising,economic development and the performance schedule requirements,Advertising law of the People's Republic of China promulgated in 2015 which revised many Legal provisions about banning tobacco advertising.And then a new law about the Internet adverising was born out in 2016.Two new laws and the Regulations on the labeling of cigarette packages in the People's Republic of China constitutes the legal regulation for the indirect tobacco advertisement in our country.Indirect tobacco advertisement legal regulation is more and more mature in our country,but even if a new law had more widely limitation on indirect tobacco advertising,the regulatory effect is still not achieve the desired goal.The legislation on tobacco advertising still has many hidden problems.For this reason,this paper will review the scope of indirect tobacco advertising by analyzing the characteristics of indirect tobacco advertisement,and find the current limitations of indirect tobacco advertising regulation in our country.Based on the current legal regulation,international convention,domestic law and Mass Communication,the study try to find out a suitable way for China which could ban the indirect tobacco advertising effectually. |
