Research On Pet Animal Protection Legislation

With the increase in the number of pet animals in China,incidents of abuse and abandonment of pet animals are also increasing,Contradictions between humans and pet animals have also gradually emerged.Due to lack of legislation,the public can only condemn through the morality when faced with the cruelty of abuse and abandonment of pet animals.However,due to the uncertainty and lack of compulsiveness of morality itself,It is impossible to effectively stop the abuse and abandonment of pet animals.Therefore,pet animal protection legislation is particularly important.Pet animal protection legislation is of great significance to both pet animals themselves and the social development of our country.It not only helps safeguard the life safety of pet animals,improves the survival status of pet animals,but also promote public moral behavior and reduce crime,so as to promote the construction of socialist spiritual civilization and the construction of a harmonious society.However,there is currently no unified pet animal protection legislation in the mainland.Pet animal protection legislation is lagging behind.At present,legal documents concerning pet animals are also mainly deficiencies in the following aspects: First,the legal hierarchy is low and one is missing.The ministry has laws or administrative regulations that govern the overall role;the second is that the purpose of the legislation is to supervise and lightly protect;the third is that the public’s participation in pet animal protection systems is not perfect;and fourth,the protection of pet animals is insufficient.China’s Taiwan region and the mainland are of the same species,and the cultural and social environment are more similar.After nearly two decades of development,the pet animal protection legislation in the Taiwan region has also become more perfect,so it has higher reference.By referring to the beneficial legislative experience of extraterritoriality,in particular the legislation of pet animal protection in Taiwan and based on the actual conditions of the mainland,this article first defines the concept of pet animals,and limits the extension of pet animals within the scope of mammals,while comparing animals.The theoretical basis of protection is that pet animals are treated as a special kind of law,which is more conducive to promoting the legislative protection of pet animals in China.Secondly,the legislative provisions for pet animal protection in Taiwan were introduced in detail and the enlightenment to China’s pet animal protection legislation was summarized.Finally,the following five suggestions are proposed for China’s pet animal protection legislation: First,establish a legal system for pet animal protection scientifically and reasonably,and establish a legal system consisting of administrative regulations,local regulations and rules;second,protect the interests of pet animals;Third,improve the public participation in pet animal protection system;fourth,expand the scope of protection and increase the degree of protection;fifth,clarify legal responsibilities and increase penalties.
