The different answers to the employment relationship and labor relations theory will determine the fate and direction of our country's employment contract legislation,employment relationship theory,and labor relations legislation.This article will be discussed in four chapters:The first chapter is to sort out the development process and legislation of the employment relationship and labor relations within and outside the domain,and to pave the way for the theoretical analysis of the last three chapters.For the second chapter,the first half mainly elaborated on the "inheritance" of employment relations in labor relations,and the latter part mainly elaborated on "labor relations beyond 'employment'."The third chapter analyzes and argues the theoretical disputes of the employment relationship and labor relations.The chapter is the core and soul of the dissertation.The first part mainly questions the "special type theory".The second part mainly deals with the refutation of "social relations".The third part mainly supports the theoretical viewpoint of “stand alone”.The main content of the fourth chapter is the author's personal improvement and thinking on the employment relationship and labor relations,divided into two parts: civil law adjustment of employment relations and private law reference of labor relations.
