A Research On The Supervision System Of Community Correction

As an innovative measure in the practice of criminal penalty in our country,community correction has enriched the single imprisonment penalty mode in our country,not only achieving the objective of punishing criminals,but also outline the purpose of rectification of criminals.But community corrections still face some issues in working practices.In particular,"supervision difficulties" have become a major bottleneck in work practices and there is an urgent need for further research.This article aims at systematically collating the development and basic content of community correction system in our country;provide a view of supervision system community correction from the legislative level and the judicial administrative level by taking Ganzhou City in Jiangxi Province as an empirical research object.Then put forward suggestions for improvement of the regulatory system for community correctionst.The article is divided into four chapters.The first chapter mainly analyzes the connotation of supervision system of community correction.This article deems that the community corrections supervision system is a system in which the court announces the control,probation,ruling and parole,and the criminals are placed in the community by the prison department to perform supervision outside the prison.The judicial administrative agency supervises and manages the system and helps them to return to the society smoothly.The community corrections supervision system has punitive,social,and diverse basic characteristics.The community correction system is the premise of supervision system of community correction and supervision system of community correction is the core of community correction system.The second chapter aims to summarize the experience of community corrections supervision at present,also the problems and dilemmas in the practice through the empirical research of the typical supervision system of community corrections in the city of Ganzhou in Jiangxi Province.There are mainly three issues in the community correction supervision system: first,the lack of relevant legitimacy support;second,the procedure has not been well-established,such as the pre-judgment investigation and assessment,the hearing system;third,there are obstacles in some implementation processes such as the role law enforcement,cross department collaboration and the capability of law enforcement.The third chapter aims to provide enlightenment for further improving the supervisionsystem of community correction in our country by studying the abroad experience of the supervisory system of community correction in the United States,Britain,Japan,South Korea and other countries.The abroad experience provide reference for China's community corrections supervision system in three aspects: the first is to refine the help content of community correction supervision;the second is to improve the application of the pre-judgment investigation and assessment system;and the third is to unify the enforcement power of criminal penalty.Chapter IV addresses the aforementioned issues and implications and proposes suggestions for the improvement of China's community corrections supervision system from three perspectives.The first is to speed up the pace of the introduction of China's "Community Corrections Law," and to improve the community corrections supervision system;second is to incorporate the pre-judgment investigation and evaluation system,the hearing system,and the supervision system for minor community corrections into the community corrections law system;third is the problems in the implementation of community corrections supervision could be solved from the aspects of clarifying the attributes of law enforcement entities,strengthening the cross departments cooperation,and cultivating supervision work teams.
