Research On The Legal Guarantee Of Equalization Of Basic Medical And Health Services In China

In recent years,the level of medical and health has been gradually improved in our country,but non-equalization of the basic medical and health services is gradually coming out.Because with economic differences among regions and the status of urban and rural dual system,the level of basic medical and health services gradually widens the gap among the residents.Every citizen should have the right to health,and people have been increasingly in the pursuit of the aim that people can have equal basic medical and health services.Basic medical and health services are an essential cause that are related to the coordinated development of a country's economy and the guarantee of national basic human rights.At present,China has already brought ‘establishing a basic health services system covering the entire population' into national planning framework,and guarantees it by part of the legislature,to ensure the implement of ‘equalization' in medical and health care sector.Nevertheless,owing to the current inadequate legal guarantee,there still remain many problems,not only the absence of specific legislation,but also the blurred division of power relationships among the governments,the unreasonable financial system,and other imperfect legal system.These issues hinder the achievement of basic medical and health services equalization from legal dimension.Therefore,this paper starts from the shortage of basic medical and health services equalization legal guarantee in China,and then analyzes the unequal phenomenon and the problems in legal guarantee.Then,relevant foreign advanced experience is drawn,and concrete system perfection from the field of legal guarantee is discussed,thus to realize the alleviation of the unequal phenomenon in health care sector,and ensurance of all citizens having equal access to basic medical and health services.The thesis consists of five parts.The first is the introduction,mainly introducing the research background and significance,research status,research content,and research methods;The second part,which is the summary of equalization of basic medical and health services legal guarantee,discusses related theoretical basis,defining relevant concepts;The third part analyzes the unequal representations in the sector of basic medical and health services,introducing some of the current legal guarantee for the equalization,and noting the existing problems;The fourth partstudies the advanced system security of the United States,Britain and Germany from the way of equalization of basic medical and health services legal guarantee in the three nations,providing useful reference for China's equalization of basic medical and health services;And finally some inspiring suggestions are provided for realization of equalization of basic medical and health services in China.
