| The "Maritime Labor Convention,2006" took effect on 20 August 2013.It is called seafarer's "bill of rights",for it fully protects the seafarers.China ratified it on 29 August 2015,and has been working to meet its claim.For example,we have issued many regulations,regulating the seafarers and their service agencies,such as"Regulation of the Crew" and so on,to make sure that the crew agency's institutional settings and operation meet the Convention's claim and protect the crew's rights,but there is a big gap between the law of crew agency and its operation in China and the Convention's claim.So,improving the crew agency is very important to be in line with the Convention.The seafarer market's development relies on crew agency's development in the context of market globalization.So,crew agencies are developing rapidly,but there are problems with their growth,and in practice,it is common that they invade seafarers' rights for their own advantage.In this situation,it is important to clear the relationship between seafarers and their agencies,ascertaining their right and duty,and strengthen the supervision and control over crew agency.This paper analyses our crew agency,taking the form of research paper,and has four parts.The first part is a introduction of crew agency,including relevant rules in the legislation of China and "Maritime Labor Convention,2006".This part also introduces seafarer recruitment and placement service,and compares it with our crew agency.The second part analyses our current legislation of crew agency,pointing out three main problems,including its unclear legal status,the low legislation level and imperfect market supervision mechanism.The third part introduces experiences of other countries' crew agency,like relevant rules of Philippine and Korea,and proposes instructions to our country.The last part is advises to the legislation of our crew agency,hoping be useful to the development of the crew agency and seafarer export market's healthy growth. |
