Children's Legal Relief Research On Domestic Violence

Domestic violence against children has been concerned and attract attention from the whole society.How to provide timely relief to children who are the victims of domestic violence and give them all-round protection is an urgent problem.China has fully recognized the importance and urgency of protecting children affected by domestic violence,and has engaged with relevant work actively,"Opinions on according to the law guardian against the interests of minors behavioral Issues","Anti domestic violence act" such series of Laws and regulations have been formulated,the academic community on this issue also began to explore and study.However,these legislation did not completely solve the problem of assisting children victims,there are still considerable deficiencies and vacancies.As a result,more efforts are needed to improve the legal relief of children's domestic violence.In addition to the introduction and conclusion,this paper is divided into four parts.The first part is an overview of the domestic violence against children.The author first defines the concept of children and analyzes the definition of domestic violence against children in some countries and our country,so as to synthesize all the factors and put forward the idea of the definition of domestic violence in our children.In addition,the analysis of the status of children suffering from domestic violence,hoping to have a general understanding of the current situation of domestic violence in our children.The second part discusses the current situation and shortcomings of the legislation of children 's legal relief against domestic violence.The author analyzes the current laws and regulations on children who are victims of domestic violence,and sums up the deficiencies in these regulations,including lack of the particularity of children and the specialized protection institutions in the legislation,the feasibility of the mandatory reporting system is lack of sexual integrity,Habeas Corpus is not specific enough,as well as the revocation of custody of the provisions of post-sentence placement is imperfect.The third part deals with the legal remedies for children who suffer from domestic violence.The author selects the United States,Japan and China's Taiwan region,and has some advanced experience analysis.Such as the mandatory reporting system of United States,the Japanese children's talking institution,Taiwan's supervision,visiting and revocation of the guardianship system,and has generalizations of the above system.The fourth part puts forward some suggestions to improve the legal relief of domestic violence against children in our country.On the basis of the analysis of the above chapters,according to the current situation of domestic violence on children,the problems existed in the relief system and the experience of our country's national conditions,relevant suggestions are put forward for improvement,hoping to help children who are the victims of domestic violence.
