Research On Domestic Violence Against Children

For many years,most of China's focus on domestic violence has been focused on the protection of women's rights and interests.However,as more incidents of domestic violence against children have been exposed in recent years,it is enough to show that China's protection of children's rights and interests in domestic violence is somewhat problematic.Deficiency,combined with traditional educational thoughts such as “doing no good” and“fighting is a manifestation of love” in China,have made it difficult to protect the rights of children who have suffered domestic violence.This article takes the perspective of domestic violence against children as the point of view.Through the introduction of extraterritorial legislative experience and practices,the author puts forward suggestions for improving China's current lack of protection of children's rights.Besides the introduction and conclusion,this article is divided into five parts.Part?: The question is raised.Through the introduction of the four typical cases of a five-year-old girl being kicked by her father,a group of four left-behind children who committed suicide altogether,a daughter's long-standing father's sexual assault,and a teenager's case of mental violence going astray,the relevant issues in this article were pointed out.Part II: Overview of domestic violence against children.This section mainly introduces the definition,types and characteristics of domestic violence against children.Part ? : The legislative introduction and commentary of extraterritorial anti-children domestic violence.This section enumerates and introduces specific legislative measures on extraterritorial anti-child domestic violence issues,including the development of special legislation against child violence,the establishment of specialized agencies to deal with cases of domestic violence against children,the establishment of domestic violence prevention mechanisms against children,and mandatory reporting.System,personal security protection order system,expost relief measures,etc.,and comment on them.Part ?: The introduction and analysis of the legislative protection of children's rights and interests in domestic violence against children.This section first introduced Chinese legislative provisions on domestic violence against children.Secondly,it analyzes the problems existing in the protection of children's rights and interests in domestic violence in China in order to target and establish countermeasures.Part V: Prevention and treatment of domestic violence against children in China.This section addresses the fourth part of our country's recommendations on the problem of domestic violence against children.We have proposed eight points,such as legislation based on children's perspectives,strengthening the prevention of domestic violence against children,and establishing a specialized agency to deal with domestic violence against children.,Improve personal security protection orders,and improve the mandatory reporting system.
