Community governance is different from top-down mode of administrative power, it emphasizes the diversity of governance subjects and the coordination and cooperation among different subjects. The rule of law in community governance is not only to strengthen the building of grassroots democratic law, reform of grassroots self-government system, but also to the use the rule of law to help us achieve community autonomy and democracy, to achieve fairness and justice and other social goals. At this stage, the country vigorously promote the rule of law, the rule of law is the basis of grassroots governance, and community governance is the focus of the rule of law. However, the rule of law is relatively weak at the present stage, the new and old problems emerge in an endless stream in the process of governance. Therefore, it is of theoretical and practical significance to explore the rule of law in community governance.Xinjiekou commercial street community is a sample of community governance. Xinjiekou commercial street community covers an area of 52 hectares, the household registration number is 11776; after five community neighborhood committee election, now a neighborhood community has one director, two deputy directors, four members of the community and ten workers.Community service organizations including the Working Committee, Women's Family Planning Commission, Environmental and Health Council, Vigilance Committee, Education Committee,these five committees are to assist the neighborhood committee in dealing with community affairs.At present, Xinjiekou commercial street community has 19 service teams, 10 community organizations and units. With the development of the construction of national legal system,Xinjiekou commercial street community governance according to law exploration has achieved preliminary results: In community governance, the neighborhood committees perform their duties according to law, establish organization according to law, establish working teams according to law, promote the autonomous system according to law, regulate the activities of community social organizations according to law and carry out legal publicity work in accordance with the law.However, affected by the wrong concept of community governance, Xinjiekou commercial street community has many traditional problems contrary to the rule of law, such as community people generally lack of the concept of the rule of law and so on, In the exploration of governance according to law, there are new problems: community neighborhood committee staff repeatedly,community regulations lack substantive content, the neighborhood election process is not legitimate, there are deviation on the implementation of national policies and regulations.Because of the fairness, justice, freedom, equality, democracy and pursuit; because the normative role of the law; because of the requirements of national policy, so the Xinjiekou commercial street community management embarked on the road of the rule of law. The above problems are mainly because: first, from the national level, the lack of scientific legislation, the legislative level is limited, supervision of legislative power is not enough, the relevant laws itself has limitations; second, from the community level,soft law governance ability is insufficient,soft law making process is not perfect and there are problems in legal practice; third also, from the individual level, not to establish a correct concept of the rule of law, neighborhood committee members have the wrong view of achievements, residents are not able to correctly understand the legal governance of community and community residents lack subjective consciousness.Therefore, the solutions are: first, perfecting the community legislation, I propose to amend the "Neighborhood Committee Organization Law", and promote community governance of soft law; second, through the establishment of a list of power to clear the responsibility of government,and improve the government's purchase of public service work; third, encourage three agency linkage, providing opportunities for community organizations and community professional personnel; fourth, strengthen the rule of law propaganda, from the aspects of democratic election,democratic supervision, democratic management, democratic decision-making and other smooth governance channels to achieve community governance by law.Finally, the research on Xinjiekou Commercial Street Community under the rule of law is the case, but the case measures to deal with the Nanjing city community governance has universal significance, and the measures applied in the practice can also highlight the rule of public utility, it has both theoretical and practical significance.
