Criminals is the socialization of individual failure,the implementation of imprisonment for the criminal intention is to punish and reform of criminals,promote the socialization of criminals,so that their society better adapt to the release and no danger to society,but the imprisonment of offenders in the community is the isolation measures,because the criminals lose contact with society in a certain extent,cannot be placed in the development of the society,can not be real-time,complete,comprehensive experience and change of social reality,and thus received the imprisonment and punishment of criminals released from prison after it is not easy to adapt to the society,this is precisely the punishment and reform of criminals.To explore and promote the departure from original low security prison,To carry out the opening part of the criminals,criminals make better contact with society,into society,return to society,to maximize the elimination of criminal prison personality,it is particularly urgent and important.The execution process from the perspective of the development of western countries,they have been in the low degree of open prisons,has been put into prison in practice,and formed a relatively perfect legal norm and standard system construction.In order to adapt to the current international socialization,humane and civilized trend,since 2003,the Ministry of justice in our country in the relevant work,plan and other policy documents,proposed to the prison in accordance with high,moderate,low The security level of the classification of construction and management requirements,but the low level of security in the prison building has no substantive legislative breakthrough.This paper applies the method of investigation and historical data investigation,through comparative analysis and summary,from our country set up low security prison legislation based on the analysis of the necessity,feasibility and legislative idea of research,from the legal position,put forward constructive suggestions on content and operation mechanism,to better improve the system of penalty execution system and execution mode,play penalty functions,maintain and protect the legitimate rights and interests of criminals,so as to provide reference.
