Labor relations are an extremely important part of our social relations. In labor relations, workers and employers are natural contradictions, any party's action to maximize the pursuits of benefits will damage the interests of the other party.Moreover, due to the huge differences between workers and employers, workers are often in a weak position of this contradictions. As the administrative activity of using public power by the government to intervene in the relationship between workers and employers,labor supervision system has played a positive role in safeguarding the legitimate rights and interests of workers and guaranteeing the relevant laws and regulations of labor and social security accompanied by the establishment of the system in both labor supervision related legislation and management. However, with the complexity of labor relations and diversification of interest demands in labor disputes, there still remains a lot of legal issues in China's labor supervision system,such as some legal cases have no administrative power due to the lack of essential means in law enforcement, Some employers and supervisors are not afraid of illegal employment and labor law enforcement because of unreasonable design of illegal liability and law enforcement is often disturbed by local authorities and so on. These legal issues has not only influenced the function of the labor supervision, but also brought specific difficulties to the labor supervision practice, which should be faced squarely. Under the premise of clarifying the value of legal problem solving in labor supervision, the government should raise the rank of legislation and deploy the power of labor supervision reasonably. What's more, the government should also solve the legal issues of labor supervision through setting the limit of labor supervision time,reforming the existing administrative system,strengthening the building of a government ruled by law and other feasibility measures and paying attention to the operation of standard administrative power in the meantime.
