The Sino-Russian WTO Rules Apply Comparative Studies

After long years of negotiations,China and Russia to become the World Trade Organization,paragraphs 143 and 156 members.China and Russia are concerned,this is a very important thing,because to join the World Trade Organization is both home to gradually improve the international status and further participation in international Affairs.The World Trade Organization to its Member States the requirements are very strict,therefore,China and Russia to do the work of many,for the legislative and judicial practice,are required to make a series of adjustments to meet the World Trade Organization to develop systems and requirements.At the same time to join the World Trade Organization the fact that has caused many problems,the domestic courts how to deal with the World Trade Organization,the rules of law and domestic law relationship,when the World Trade Organization rules and domestic law when a conflict occurs,how to dispose of it.The domestic judiciary can direct the implementation of World Trade Organization rules,this question becomes more relevant.The World Trade Organization agreements in the Member States within the implementation and enforcement of face is not only a theoretical problem,more is a practice problem.State agencies how to accept the WTO Agreement and rules,the World Trade Organization rules in the domestic legal system of the status.For these problems many Chinese and Russian scholars have been explored.This article is divided into three parts,the first part from the Chinese nd Russian academia angle,introduce a different perspective on WTO rules concept,its nature,mainly designed it and the origins of the system;The second part combed by China and Russia to join the World Trade Organization process,the main description of China and Russia to join the World Trade Organization,the preparations for and accession to the WTO for the two countries affected,and from the legislative,theoretical and judicial practice aspects of Chinese and Russian international treaties and the World Organization of the trade agreement applicable to the analysis,and briefly research the main members of the World Trade Organization the rules applicable to the attitude;the third part mainly analyzes the China-Russia on the application of the World Organization of the trade rules of the legislative and judicial issues,and proposed the related countermeasure proposal.
