Research On The Exit Mechanism Of Rural Residential Land

With the deepening reform of industrialization, urbanization and agricultural modernization, outstanding problems on the area's excess, the size's large, human decrease but land increase and one family but many homesteads, result in the conflict between the economic growth and the protection of cultivated land, and then bring pressure to bear on the protection of cultivated land in the process of urbanization. The legal characteristics of the closure and unscientific subject right, the restrictive object right, acquisition of rights free sex, non maturity of rights, fitness of right content and limit of the disposition right, of the rural residential land use right, seriously affect the enforcement of the withdrawal mechanism of rural residential land. The rural residential land use right has a close connection with the urban-rural dual structure, social security, household registration and so on, and that makes us realize the complexity of the withdrawal of the rural residential land, and the magnitude of the reform of the mechanism. The use right system of rural residential land is an important part of the land system of our country. In current system of rural residential land, the withdrawal mechanism of rural residential land is not well organized, lack of operability and perform ineffectively. The rural residential land in Chuxiong Yi Autonomous Prefecture, which is a part of the rural residential land in China, also faces the same situation.This paper is an empirical analysis of Chuxiong Yi Autonomous Prefecture as a point of penetration and analyses the state of the withdrawal mechanism of rural residential land, by the reference and the cases, the working experience in Xihe and Heshanzhuang village committee, Wuding county, Chuxiong prefecture, and the first hand information from Land Resource Bureau, Immigration Administration Bureau and Poverty Alleviation and Development Office in Chuxiong city, Chuxiong Prefecture, and then, put forward some suggestions and countermeasures. I expect that the withdrawal mechanism of rural residential land carry out reasonably, legally, efficiently and orderly, by comprehensively analyzing the perfect system of the withdrawal of rural residential land and the correlative policies of social security system and the system of registration of real estate.
