In March 15,2016,the people's Bank of Chinese,China Banking Regulatory Commission(CBRC)and China Insurance Regulatory Commission(CIRC)Jointed related departments jointly and issued "Interim measures for mortgage loans pilot of management right of rural contracted land" and "Interim measures for the mortgage loans pilot of farmers' housing property rights",which lays down the matters needing attention and specific implementation measures of "Two rights" mortgage financing,marking agricultural land mortgage financial pilot launched nationwide.The agricultural land financial system with "two rights" mortgage as the main content can provide financial support for the development of rural economy,and plays an important role in promoting the development of agricultural production,the rich life of farmers and the progress of rural reform.However,due to the external environment and internal operating factors,the current financial risks faced by the implementation of farmland mortgage are very prominent.Therefore,studying the risk of land mortgage finance and seeking the effective path of regulation of rural land mortgage finance risk,not only help to promote the success of the two rights mortgage pilot and establish perfect rural land financial system,but also help to strengthen the role of financial support for agriculture,and ultimately promote the prosperity and development of rural economic.In addition,the study of agricultural land mortgage financial risk regulation system has important theoretical significance to enrich the rural financial risk control treasury and the comprehensive management theory of financial risk.From the current research status,there are few specific studies on the financial risk regulation system of farmland mortgage.Because the land mortgage financial risk regulation is an important part of rural financial risk management,it is necessary to carry out specific and detailed research on farmland mortgage financial risk and regulation system,so as to provide theoretical support for the success of nationwide pilot of agricultural land mortgage system.This paper begins with the definition of the financial risk of agricultural land mortgage,summarizes the characteristics of financial risk,and then analyzes the causes of risk,which provides a way to discuss the path of risk regulation.On this basis,this paper discusses the basic logic of financial risk regulation of farmland mortgage and basic models of risk regulation in each pilot area emphatically,summed up the risk regulation strategies include legal regulation,economic regulation,administrative regulation,social regulation and regulation of technology,and discusses experience of each area's risk regulation mode which can learn from and their existing problem.Finally,according to the existing problems of risk regulation model,this paper puts forward various measures pertinently.The study found that promoting the farmland mortgage finance risk regulation to achieve good results,should proceed from the following aspects: one is to perfect the relevant legal regulation of land mortgage financial risk,especially to define the clear definition of property rights of rural land ownership;two is to locate government risk regulation functions reasonably,reduce direct government intervention in land mortgage finance market;three is to improve the services and supervision level of financial institutions,enhance their ability to resist risks;four is to guarantee the agricultural insurance service level,give full play to the role of risk mitigation effect of agricultural insurance;five is to improve the risk regulation supporting organizations and security measures,to ensure the smooth operation of farmland circulation and farmland valuation etc.The article is divided into six parts: the first chapter,introduction,is the background,purpose,significance,research structure and research status at home and abroad.The second chapter expounds the basic theories of the article,and it defines the meaning of land mortgage finance risk,analyzes the characteristics and causes of the risk of land mortgage finance,and provides ideas for the further study of risk regulation.The third chapter focuses on the analysis of meaning of the rural land mortgage financial risk regulation,and discusses the basic logic of risk regulation in detail,and summarizes the details of risk regulation strategies including legal regulation,economic regulation,administrative regulation,social regulation and regulation of technology.The fourth chapter: according to the current practice of farmland mortgage pilot,summarizes the basic models of risk regulation of each area,and analyzes the experience and problems of these risk regulation models.The fifth chapter: according to the problems of risk regulation model,this paper puts forward the corresponding solutions.The sixth chapter: conclusion and prospect,make an objective analysis of the research results,and make prospects and ideas for the next research.
