The trend of large-scale development of agricultural industrialization in China is becoming more and more obvious,and the emergence of various new types of business entities has increased the demand for capital investment in agricultural production.In the absence of collateral in rural areas,in order to meet the funding needs of the majority of farmers and new business entities,the government issued a policy of “three rights separation”of agricultural land property rights,allowing land management rights to be used as collateral to apply for loans from financial institutions.The trial work of rural land management rights mortgage loans continued to advance.Each pilot actively explored the operation mode of farmland management rights mortgage loans based on its own characteristics.A number of typical pilot projects with good effects appeared and achieved certain results,but in the current economy and law.Under the environment,there are still many problems in the practice of each pilot.The land management right is used as collateral.The unreasonable valuation and disposal predicament have become an important issue that restricts the effective implementation of rural land management rights mortgage loans.Therefore,rural land management rights The valuation and disposal of mortgage collateral has become a subject worthy of study.This paper first reviews the literatures of relevant domestic research,and discusses the theoretical basis of land property rights theory,land rent theory,asset valuation theory,land transfer theory.Secondly,this paper interprets the connotation of the three rights division of land property rights,defines the rights and contents of ownership,contracting rights and management rights,and introduces the related concepts of rural land management rights mortgage loans,and the existing rural land.The mortgage model of management rights is divided into “pure mortgage type” and “mortgage + guarantee type”,which are represented by pilot models in Pingluo County of Ningxia and Tongxin County of Ningxia,respectively.The characteristics of the process are elaborated and analyzed,and the current rural areas are summarized.There are two problems in the mortgage of land management rights,including the imperfect valuation system of land management rights and the difficulty in handling collateral.Thirdly,this paper starts from the perspective of land rent theory and land rentcapitalization to determine land price.It fundamentally discusses the evaluation principle of land management rights value,which is determined by factors such as income,risk and time limit.The value of land management rights is expressed as future income.Based on the results of the current summarization,the applicability of the capital evaluation method in land valuation is analyzed,and the applicability of the income reduction method is the highest.Then the specific practices of the existing land management rights valuation are analyzed.It points out the problems of incomplete factors and lack of professional institutions.It is very important to summarize the land management rights valuation system and the land property rights trading market and establish a professional land evaluation agency as soon as possible.Then based on the principle of collateral disposal in real estate mortgage,the analogy is that the general rule of disposal of defaulted land is that the land management right is disposed of by the creditor,and the characteristics of the land management right as collateral are considered,and the need to dispose of the default land is pointed out.Attention to the problem:land marketability,land social security function,rent payment method make the land transfer contract potentially unstable,then analyze the existing default land disposal mechanism of the pilot,and point out that its land value assessment is unscientific,land The property rights trading market needs to be improved and so on.It is of great significance to summarize the land transfer market and establish a land property rights trading center to promote land transfer.Based on the above analysis,the paper puts forward some suggestions for improving the land management rights valuation system,improving the land transaction market,and establishing a multi-level risk protection sharing mechanism.
