On The Status Of Commercial Subject Of Mobile Vendors

From the current stage of China's economic and social development,the existence of mobile vendors has its inevitability and importance.Their business activities are the need to maintain their own survival,but also to facilitate the lives of the masses,to promote employment and entrepreneurship,improve people's livelihood,maintaining social harmony and stability and other aspects play an important role.Mobile vendors have become an important group in the development of China's socialist market economy.However,in the real world,they are not allowed by the city management departments,such as the conflicts and conflicts between the street vendors and urban management.The street vendors of the environment is not optimistic,not only because the mobile vendors operating activities on the environment,transportation,etc.the appearance of a negative impact,the reason is that the legal status of the vendors do not have the law.This article is from the elements of the commercial subject as the starting point,combined with the characteristics of mobile vendors,the analysis of the academic subject status on the street vendors in the dispute,the use of comparative analysis means method,historical analysis,value analysis and other research.Specifically,the first chapter introduces the concept and definition of mobile vendors,the reasons for the formation of mobile vendors,the status quo and problems.The second chapter,the third chapter is the core of this paper is from the basic theory of commercial subject,elements and characteristics of the commercial subject,combined with the typical foreign countries and China's Hong Kong and Taiwan legislation analyzes the necessity of endowing our vendors commercial subject status,that should be incorporated into the commercial subject category of mobile vendors.The fourth chapter puts forward the ways and measures of our country.Through the improvement of legislation,legal advocacy,lower threshold,broaden the channels of relief relief,the establishment of autonomous organization,the formation of the government management and self-discipline management mode,to ensure the harmonious development of the normal operation of mobile vendors and city management department.
