The Research On The Ensuring Peasants' Rights And Interests Duing The Rural Land Circulation In The Three Rights Division Theory

Land is basic for agriculture development.It is not only the economic security for peasants' life but also the fundamental measure to stabilize the rural society.Rural land circulation is the most effective way to enhance the efficiency of land use.It is the key way to construct socialistic new countryside,which will benefit the integration of urban and rural areas and the development of agricultural modernization.All of these will be a great help for a higher living standard of the peasants.At present,rural land circulation has been held in most of our rural areas.There exists variety of ways.The establishment of market economic system promotes the development of rural economy,which leads to the increasing rural outward labors and the accelerating of rural land circulation.However,certain policies and contradictions between government and peasants led to a severe loss of peasants in the process of rural land circulation,mainly focusing on the profit of land circulation,the related rights concerning lands,the basic social ensuring system,peasants' employment,obscure property rights in rural land,positioning of local governments,nonstandard operational procedures,peasants' own limitations and so on.Due to the violation of peasants' legitimate rights and interests,the phenomena of peasants' petition and contradictions between the government and peasants are getting worse,which will be a negative impact on China's economic and social sustainable development.In the stable social environment,rural land circulation benefits the optimization of land resource distribution,the restructuring of agriculture and the growth of agriculture economy.So as to improving the agricultural technology and peasants' income,transforming traditional agriculture into modern agriculture is a necessity.This thesis combines rural land circulation with the rights and interests of peasants.Mainly based on the specialized knowledge of Management,Economy,Law and focusing on the infringement of peasants' rights and interests,this thesis gives a detailed analysis in the above conditions and causes and proposes several workable measures.The first chapter discusses the background,the meaning,the research status,the research idea and approach.The second chapter explains the related concept of the land circulation policy and the theory of the assurance of peasants' rights and retrospects the historical evolution of the land circulation in China.The third chapter analyzed the problems relate to land circulation.The fourth chapter provides several suggestions which lead to the improvement of peasants' right in the revolution of land circulation.
