Funding is an essential element of modern agricultural inputs.In recent years,along with the process of agricultural modernization,farmers land contract management rights of the transfer was significantly accelerated,agricultural scale operation into an inevitable trend,the demand for funds is also increasing.However,due to the natural risk and economic risks in agricultural production coexist,the lack of collateral and other factors caused by the large risk of loans,resulting in farmers and new agricultural management of the main problem of loans to its agricultural production in the capital investment have a greater impact,Which restricts the scale effect of production and operation and reduces the investment enthusiasm of farmers and new agricultural enterprises.In order to increase the financial support for agricultural development,in the context of rural land to speed up the right,land contract management mortgage came into being.Looking at the national pilot situation,the land contract management right mortgage loan to a certain extent,alleviate the difficulties of farmers and agricultural management of the main difficulties,and achieved some success,but the enthusiasm of financial institutions to participate in the enthusiasm is not high,Policy role is limited.There are many factors that affect the enthusiasm of financial institutions to carry out land contract management mortgage business.Among them,the lack of the Land contract management right mortgage disposal mechanism has the greater influence.Therefore,it is of great practical significance to study the construction of the mortgage disposal mechanism of land contract management right,it can effectively carry out the effective implementation of mortgage loan and effectively use of property rights and interests.The research content of this paper is divided into six parts: the first part discusses the background,significance and research status of the construction of mortgage disposal mechanism of land contract management right.The second part elaborates the relevant theories of land property right,land rent price and mechanism design,and provides theoretical guidance for the construction of mortgage disposal mechanism of land contract management right.The third part discusses the necessity of constructing the disposal mechanism by analyzing the influence of the lack of mortgage disposal mechanism,and then discusses the basic principles and the overall framework of the construction of the mechanism.The fourth part constructs the responsibility mechanism of the land contract management right mortgage disposal mechanism,clear theinterests of the relevant stakeholders and obligations and mediation of Interest disputes.The fifth part constructs the operating mechanism of mortgage disposal mechanism.According to the different stages of mortgage disposal,the key points such as value evaluation,disposal mode selection,disposal period and period of ownership period are discussed to make the disposal mechanism work effectively.The sixth part puts forward the suggestion of the operation guarantee from the angle of law and system.
