Research On The Role Of Government In Rural Collective Land Acquisition

In the Central Document No.1 of 2018,it was emphasized that it is necessary to deepen the reform of the land system,further promote the system of land property rights,and strengthen the institutional supply of rural rejuvenation strategies.The proper settlement of rural land issues involves the stability and development of rural society.Chinese government is the only subject with legal land acquisition rights.Due to the huge benefits of non-agriculturalization of farmland and the inherent defects of farmland property rights,the process of land acquisition is full of intricate interests.Multi-stakeholders in land acquisition participate in the struggle for rural land rights and interests,which caused many land acquisition disputes and conflicts.In order to promote the sustainable development of agricultural land,the protection of cultivated land,and the maintenance of the harmony and stability of rural society,the government needs to clarify the role played in the collection of rural collective land and accurately play its role in the collection of rural collective land.Due to frequent disputes over land acquisition and conflicts,China has successively implemented vertical management of land management systems and land supervision systems to prevent and curb illegal activities of land acquisition.But the actual results are not obvious.Based on the theory of public choice and principal-agent theory,this paper analyzes the main problems and specific reasons of government role-playing in China's current rural collective land acquisition,and further standardizes land acquisition premise “public interest”,specifies the main body of agricultural land property rights,land requisition compensation system,and fiscal The performance assessment system,supervision and restriction mechanism and rights and remedy measures propose to standardize the government's role-playing strategy in rural collective land acquisition.As a result,the government can play a role in the return of rural collective land,which can play a role in the public interest of land acquisition,theguarantor of land rights,the delimiter of property rights,and the interest coordinator.
