Under the New normal of Chinese economy, export upgrading becomes more and more important for the quality and efficiency of foreign trade and the healthy development of the national economy. In the context of China's special system, this paper focuses on how to stimulate and guide innovation mechanism to promote the upgrading of the level of export technology. With the continuous development of the market reform of China's economy, market competition,as the external environment of enterprise decision-making on innovation, can stimulate innovation to become the backbone of export upgrading in China? Can the system of intellectual property protection which improves the expected income of innovation bring about more innovation to promote export upgrading while ensuring full competition?Answering these questions will help to improve the market competition mechanism and the implementation of the intellectual property protection system, which is of great practical significance for China's export upgrading and fostering new competitive advantages of foreign trade. Therefore, this paper uses the panel data of China's industries to study the impact of market competition and intellectual property protection on China's export upgrading, and explore the path and mode of China's export upgrading. This article firstly expounds how market competition and the protection of intellectual property right influence export upgrading on the basis of the research of Aghion et al(2015)and other papers;then export upgrading is measured by the method of Rodrik(2006)and Hausmann et al(2007),the panel data of 31 industrial sectors from 2000 to 2014 is used for empirical estimation by SYS-GMM with the help of the econometric model after the overall and industry-level measurement of relaxed indicators. The results show that the trend of the overall export technical level in China's industry is becoming more and more obvious, but the difference of each industry is relatively large during the sample period; The industries of high export sophistication and the intense protection of intellectual property rights are mostly concentrated in the technology-intensive industries while the export sophistication and the protection of intellectual property rights in labor-intensive industries are generally low.On the whole, the degree of market competition and the protection of intellectual property rights in various industries are gradually strengthened;Market competition plays a positive role in promoting the export sophistication while the protection of intellectual property rights can help market competition together to promote export upgrading by fostering more innovation of industrial sectors more effectively even though its overall effect is negative.R&D investment,FDI and the scale of the industry have a significant role in promoting China's export technology upgrading, while the import trade and capital deepening can promote the upgrading of export technology but not significant. Therefore,it's necessary to further improve and perfect the mechanism of market competition and rationally adopt the policy of intellectual property right to foster essential innovation and promote export upgrading.
