Rural collective construction land circulation is strictly restricted,then the government began allowing pilot rural collective construction land circulation,at present the government policies support the rural collective commercial construction land into the market,it's not only the requirement of deepening reform,but also China's inevitable direction of economic and social development.This paper firstly analyzes the policy basis and legal basis of the rural collective commercial construction land into the market in China.This paper briefly reviews the situation of songjiang district and gives a brief introduction to the selection of plot for the rural collective construction land into the market in songjiang district.Then the paper introduces the instance of songjiang district rural collective construction land into the market.This paper defines the "Songjiang model" and puts forward the definition and the judgment standards of "Songjiang model",And on this basis,"Songjiang model,is analyzed:On the basis of property right system reform of the rural collective assets,clear township collective economic organization as the main body in the market;To improve the system of confirmation of the right to the rural collective commercial construction land management;Establish and improve the market trading rules and service supervision system of unified construction land;To improve the distribution system of land value-added income;Improve the market supervision and management system and improve the legal relief system.The "Songjiang model" has made some achievements in the exploration and practice of the rural collective commercial construction land into the market.Of course,there are some problems of "Songjiang model",such as the imbalance distribution of land value-added income about "the rural collective commercial construction land into the market”and“land expropriation"?the problems of tax collection and administration?the problems of land ownership change,the problems of higher capital requirements,restricting the rural collective commercial construction land into the market smoothly and the problems of lack of village land use planning.In order to improve "Songjiang model",this paper also puts forward some suggestions:Stick to the planning orientation and coordinate the relationship;To safeguard the rights of farmers and coordinate the relationship between social security and multiple compensation;To define the legal status of township collective economic organization;To rationally distribute the revenue of the rural collective commercial construction land into the market,to explore the ways of solving problems about the tax collection and administration;To strengthen the supervision and protection of farmers' collective assets and farmers' rights and interests;In combination with the pilot practice,to deal with the relationship between pilot exploration and suggestions on amending the law.Finally,some conclusions of this paper are presented.
