Research On The Environmental Damage Appraisal And Assessment System

In recent years,environmental damage caused by environmental pollution and ecological devastation has intensified.And the lag and lack of environmental damage compensation makes the victims cannot get the compensation and the ecological environment is not timely restored,with environmental damage appraisal and assessment coming into being.As a pre-program for environmental damage compensation,results of appraisal and evaluation provided by environmental damage appraisal and assessment are bases for it.Our country is in the early stages of environmental damage appraisal and assessment,which tends to be limited in the practice because there hasn’t set up a comprehensive legal system.Accordingly,at institutional level it needs to be provided,which will be better assisted to conduct environmental damage compensation activities.This article attempts to use the theoretical analysis,comparative analysis and empirical analysis to study the environmental damage appraisal and assessment system in china.Starting from the basic concept,firstly this paper introduced the legislation,agency,scope,procedure,capital protection,supervision and management of this system and pointed out the problems:such as legislation is imperfect,institutional qualification confusion,lack of financial security,etc.Then it described the United States and the European Union’s environmental damage assessment system.Implications of these provisions to China were at the end of this part.In the end of this paper,it was mainly for the suggestions of the key issues raised in the china’s environment damage appraisal and assessment system.First,we must improve the legislation on environmental damage appraisal and assessment.Second,specialized appraisal and assessment agency should be established.Third,the scope of appraisal and assessment needs to be expanded.Fourth,we should improve the appraisal and assessment procedures.Fifth,there’s also need a security mechanism.At last,liability for violations needs to be clearly defined.It will be expected that this paper is about to have some value in boosting the development of environmental damage appraisal and assessment system in China.
