Study On Legal Issues Of Environmental Pollution Prevention And Control Of Rural Solid Wastes In China

In China's past economic development path,resource allocation is more focused on cities than rural areas,which makes the treatment of solid hazardous waste in cities,especially in first-and second-tier cities,more scientific and timely.Solid waste in rural areas has not received a certain degree of attention.This article intends to sort out the environmental law of rural solid waste from five chapters.That is,the main body of the article can be divided into five parts,namely,introduction,overview,legislative status and problems,foreign experience,and improvement suggestions.The first chapter,the introduction part,will be composed of three sections:The first section mainly discusses the purpose and significance of the research.Fully elaborate the background of rural solid waste pollution laws,and raise environmental issues in rural areas from environmental issues,and then introduce legal issues in rural solid waste.The analysis of meanings from four angles is the development of environmental protection in rural areas,the protection of people's life and health,the promotion of sustainable development of agriculture,rural areas and the importance of rural revitalization in the new era of China.The second and third sections respectively describe the research status and research methods.In the current research situation,it briefly expounds the foreign and domestic research results and aspects worthy of reference,and cites the research concepts of other domestic scholars to elaborate the rural solid waste pollution laws.In terms of research methods,it is elaborated from three aspects:comparative analysis method,literature analysis method and practical analysis method.In the second chapter,the overview is divided into three sections.They are respectively explaining concepts,classifications and hazards.The author divides rural solid waste into rural domestic waste,aquaculture solid waste,plantation solid waste,and agricultural film waste.Among the hazards,there are hazards to water bodies,hazards to the soil,hazards to the atmosphere,hazards to agriculture,and harm to the human body.The third chapter is about the status quo and existing problems of legislation.The four aspects of laws,systems,administrative regulations and local regulations are elaborated separately.From the big direction,we will clarify the correlation between the upper and lower methods,the relevant laws and regulations,and the existing problems.Summarize two environmental public interest litigation cases According to the author's information and work,analyze the problems existing in rural solid waste pollution in HeLong District.The fourth chapter,foreign experience,sorts out and discusses the environmental law issues of rural solid waste in Japan and Germany.This leads to the enlightenment to China,the concept of circular economy as the legislative guiding ideology;the improvement of the legal system,the improvement of relevant supporting regulations;the strengthening of the construction of environmental law enforcement teams;the promotion of green concepts and the increase of public participation.The fifth chapter,suggestions for improvement,based on the problems in the previous section,propose improvements.This chapter proposes environmental pollution from rural solid waste from five perspectives:adding environmental rights;improving laws and regulations;strengthening rural environmental law enforcement;clarifying the responsibilities of all parties;and improving the public participation system.
