| The classification of domestic Waste sorting is related to the daily life of the people,and is of great significance for promoting the construction of ecological civilization,improving the degree of social civilization,and innovating grass-roots social governance.In December 2020,the Opinions on Further Promoting the Work of Domestic Waste sorting jointly issued by 12 departments including the Ministry of Housing and Urban Rural Development clearly pointed out that "we should promote qualified places to accelerate the legislative work of domestic garbage management and establish and improve the legal system of domestic Waste sorting classification".The Law on the Prevention and Control of Environmental Pollution by Solid Wastes,revised in 2020,specifically regulates the classification of domestic Waste sorting at the legal level,providing guidance for local legislation on the classification of urban Waste sorting.The further revision of the Legislative Law in 2023 has expanded the scope for cities with districts to legislate on "ecological civilization construction" and formulate local regulations.With the expansion of local legislative bodies,the number of local legislation on the management of domestic Waste sorting classification is increasing,which effectively promotes and guarantees the work of domestic Waste sorting classification in local cities.However,in practice,the classification effect of urban domestic waste is not ideal due to the lag,operability and lack of local innovation of the legislative concept of domestic Waste sorting classification management,and the existing legal system still cannot effectively respond to the needs of local urban Waste sorting classification management.In order to solve this problem,this paper,based on the principles of legislation and jurisprudence,uses comprehensive research methods such as comparative analysis,literature analysis and empirical analysis to systematically sort out the policies and laws of domestic Waste sorting classification,and compares and analyzes the local laws and regulations and systems of some typical urban Waste sorting,so as to put forward feasible strategies for improving the local legislation of urban Waste sorting management.This article consists of five parts.The first part of the introduction mainly elaborates on the legislative background and research significance of urban household waste classification,reviews the current research status of domestic and foreign scholars on urban household waste classification,as well as the content,methods,innovations,and shortcomings of this study.The second part summarizes the rise and development of local legislation on urban household waste classification.Domestic waste classification,as a part of the rule of law in the construction of ecological civilization,has received high attention at the national level.In the process of legislative development from the state to the local level,the expansion of local legislative bodies has a profound practical foundation.The local legislation of the household waste classification system is in line with the trend of the times and conforms to the opportunities of the times.The local legislation on the classification of urban household waste presents three stages: guided,pilot,and mandatory,which have laid the legislative foundation for the classification of urban household waste.The third part mainly conducts sample analysis on local legislation on urban household waste classification.After reviewing the legislative overview of domestic waste classification at the national level,a comparative analysis was conducted on the local legislation of domestic waste classification in some typical cities.It was found that there are similarities and differences in legislative principles,classification standards,fee systems,reward and punishment measures,subject responsibilities,and regulatory mechanisms among different cities.The fourth part summarizes the main issues that exist in local legislation for urban household waste.By comparing and analyzing the legislative content of some typical cities,it was found that there are problems in the local legislation of urban household waste classification,such as incomplete legislative system,incomplete system,unreasonable setting of main responsibilities,and inadequate regulatory mechanisms.The fifth part proposes strategies and approaches for improving local legislation on urban household waste classification,providing suggestions for the steady development of legislation. |
